Terms of service

This English version is provided for your convenience. Only the German version is legally binding. The contract language is German (see § 3 (4)).

§ 1 Scope, provider

(1) These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop at delcube.com and via individual requests by email or contact form between

delcube GbR
Berger Vorstadt 33b
86609 Donauwörth
Germany
Partners: Janis Langer, David Furthmüller, Radoslaw Ochab
Email: info@delcube.com

(hereinafter "delcube" or "we") and the customer.

(2) A customer is any natural or legal person who concludes a contract with us. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (Section 13 German Civil Code, BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or self-employed professional activity (Section 14 BGB).

(3) Deviating, conflicting or supplementary terms of the customer do not become part of the contract unless we expressly agree to their validity in writing.

§ 2 What delcube offers

(1) delcube develops characters with their own stories and turns them into physical objects. The focus is on the character, not on a particular material. Our products can therefore be made from different materials and using different processes, for example as sewn textile and plush objects, as plastic or resin objects made by additive manufacturing, as cast, milled or hand-worked objects, and from combinations of these materials.

(2) The material and process of a product are stated in the respective product description. This information is authoritative.

(3) In addition to products from the shop, we offer custom one-off pieces (§ 5) and digital services such as 3D design, visualizations or animations (§ 6).

§ 3 Conclusion of contract in the online shop

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) The ordering process works as follows:

  1. The customer adds products to the cart.
  2. At checkout, the customer enters their details and chooses the shipping and payment method.
  3. Before submitting, the customer sees an overview of all details and can correct them using the edit links at checkout or the browser's back function.
  4. By clicking the "Buy now" button, the customer submits a binding offer to purchase the goods in the cart.

(3) Immediately after ordering, the customer receives an automatic email confirming receipt of the order. This confirmation of receipt does not yet constitute acceptance of the offer. The contract is concluded when we accept the order in a separate email or ship the goods, but at the latest when the payment process is completed for payment methods with immediate debit (e.g. PayPal, credit card, Apple Pay, Google Pay).

(4) The contract language is German. We store the contract text and send the customer the order details and these GTC by email. The GTC can also be accessed at any time on delcube.com. If the customer uses a customer account, they can view their orders there.

(5) The customer is responsible for ensuring that their details, in particular email address, delivery address and information for personalised products, are correct and complete.

§ 4 Material, production and handcrafted characteristics

(1) Many of our products are made in small quantities and by hand. Slight deviations from the product photos in colour, shape, size, surface, seams or pile direction are therefore possible. They are a feature of individual production and not a defect, provided they do not impair usability and are reasonable for the customer. Colours may also look different depending on the screen.

(2) Textile and plush objects: faux fur may look lighter or darker depending on the pile direction. Slight differences in filling and seams result from the handwork. The care instructions in the product description must be observed.

(3) Objects made by additive manufacturing (plastic, resin): production-related characteristics such as fine layer lines, slight surface irregularities or small traces of support structures are typical of the process and not a defect, provided they do not impair function and are within the usual range.

(4) All materials: resistance to heat, UV light, moisture and mechanical stress depends on the material. Notes in the product description, for example on heat resistance, UV stability or care, must be observed.

(5) Our products are decorative and collectible objects for adults and not toys. They are not intended for children under 14 unless expressly stated otherwise in the product description.

§ 5 Custom one-off pieces

(1) Custom one-off pieces (e.g. own characters, figures, objects or personalised variants) start with a request from the customer. We then prepare an individual quote with the scope of work, material, price and expected timeframe. The contract is concluded when the customer accepts this quote in text form (e.g. by email).

(2) Before production, the customer usually receives a draft (e.g. sketch, 3D model or visualization). Once the customer approves the draft in text form, it becomes the binding basis for production. The price includes 2 rounds of revisions. Change requests after approval may incur additional costs and longer delivery times; we will inform the customer of these in advance.

(4) The delivery time for custom one-off pieces only begins once all details regarding design, material and technical feasibility have been clarified and the draft has been approved.

(5) If the customer provides their own templates (e.g. drawings, designs, logos, photos or 3D models), they warrant that they hold the necessary rights and that the implementation does not infringe any third-party rights (in particular copyright, trademark, design or personality rights). The customer indemnifies delcube against all third-party claims based on such an infringement, including the reasonable costs of legal defence. This does not apply if the customer is not responsible for the infringement.

(6) We reserve the right to refuse orders that violate legal regulations or contain pornographic, violence-glorifying, discriminatory or otherwise offensive content.

§ 6 Digital services (3D design, visualization, animation)

(1) For digital services (e.g. 3D modelling, renderings, animations or graphic work), the scope of work described in the quote and § 5 (1), (2), (5) and (6) apply accordingly.

(2) The rights of use to the work results only pass to the customer upon full payment and only to the extent agreed in the quote (type of use, period, territory). Unless otherwise agreed, the customer receives a simple right of use, unlimited in time and territory, for the agreed purpose. Open project files (e.g. source files of the 3D software) are only owed if this has been expressly agreed.

(3) We may show the work results for our own promotion (e.g. portfolio, website, social media) unless otherwise agreed with the customer.

§ 7 Rights to delcube characters

All characters, worlds, designs, names, images and texts by delcube (e.g. Flake and the Crypt Ooze universe) are protected by copyright and, where applicable, trademark law. By purchasing a product, the customer acquires ownership of the respective object, but no rights to the underlying character or design. Reproduction, imitation or commercial use is not permitted without our prior consent.

§ 8 Prices and payment

(1) The prices stated in the shop at the time of the order apply.

(2) In accordance with Section 19 of the German VAT Act (UStG), no VAT is charged or shown.

(3) Shipping costs are added unless otherwise stated. They are clearly shown on the product page or in the ordering process before the order is placed. Details can be found in our shipping policy.

(4) Payment is made using the payment methods offered at checkout. The purchase price is due immediately upon conclusion of the contract, unless otherwise stated for the chosen payment method.

§ 9 Delivery and retention of title

(1) We deliver to the delivery address provided by the customer within the following countries: Germany.

(2) The delivery time for products from the shop is stated for each item. The delivery time for custom one-off pieces is governed by § 5 (4) and the quote.

(3) If an ordered product is unavailable through no fault of our own, we will inform the customer without delay and refund any payments already made without delay.

(4) The goods remain our property until paid in full.

§ 10 Right of withdrawal

(1) Consumers have a statutory right of withdrawal. Details, in particular deadlines, consequences of withdrawal and the model withdrawal form, can be found in our cancellation policy.

(2) The consumer can also declare withdrawal electronically using the "Withdraw from contract" function on our website.

(3) The right of withdrawal does not apply to contracts for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (Section 312g (2) No. 1 BGB). This applies in particular to custom one-off pieces and personalised products under § 5, regardless of the material.

(4) For digital services under § 6, the statutory provisions on the right of withdrawal for services or digital content apply. This includes the early expiry of the right of withdrawal if the consumer has expressly agreed that we begin performance before the withdrawal period expires.

§ 11 Warranty

(1) The statutory rights for defects apply. Characteristics under § 4 are not defects.

(2) For entrepreneurs, the limitation period for claims for defects in newly manufactured items is one year from delivery. This does not apply to claims for damages under § 12 or in the case of fraudulent concealment of a defect.

(3) The customer should report obvious transport damage to the delivery driver immediately if possible and notify us. This makes it easier to settle the matter with the carrier; the consumer's statutory rights remain unaffected.

§ 12 Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, for damage based on intent or gross negligence, and under the German Product Liability Act.

(2) In the case of slight negligence, we are only liable for breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely (cardinal obligation). In this case, liability is limited to the foreseeable damage typical for the contract at the time the contract was concluded.

(3) The above limitations of liability also apply in favour of our partners, employees and vicarious agents.

§ 13 Data protection

Information on the processing of personal data can be found in our privacy policy.

§ 14 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Customers can reach us with questions or complaints at info@delcube.com.

§ 15 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the country in which the consumer has their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contract is the registered office of delcube.

(3) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
