Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, other merchants and Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights with respect to your personal information here: Shopify Privacy Portal link.

Chat (Shopify Inbox)

On our website we offer a chat through which you can ask us questions. The chat is a service provided by Shopify (Shopify Inbox). For users in the EU, the provider is Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland.

  • When you visit the website: the chat window is loaded on every page. Shopify processes technical data such as your IP address, browser and device information and the page visited, which are needed to display the chat.
  • When you use the chat: we process the content of your messages, the time and the page from which you are writing. If you provide your name or email address, we also process these, for example to reply to you by email.
  • In your browser: so that your conversation history is kept when you change pages, the chat may store information in your browser. This is strictly necessary for the service you requested (Section 25 (2) No. 2 TDDDG).

The legal basis for inquiries about an order or a commission is the performance of a contract or the implementation of pre-contractual measures (Art. 6 (1) (b) GDPR). For all other inquiries and for loading the chat, it is our legitimate interest in offering you an easy way to contact us and answering your questions (Art. 6 (1) (f) GDPR). We store chat histories for as long as is necessary to process your inquiry and delete them afterwards, unless statutory retention obligations apply. You can find more information in Shopify's privacy policy.

Spam protection (hCaptcha)

To protect our forms (for example the contact form, customer account and comments) against spam and automated access, Shopify uses the hCaptcha service of Intuition Machines, Inc., USA. When you submit such a form, your browser loads a script from hCaptcha. Data such as your IP address, browser and device information and details of your interaction with the page are transmitted to hCaptcha in order to check whether the input comes from a human. hCaptcha may store or read information on your device for this purpose.

The legal basis is our legitimate interest in protecting our website against misuse and spam (Art. 6 (1) (f) GDPR). Storing and reading information on your device is strictly necessary for submitting the form you requested (Section 25 (2) No. 2 TDDDG). You can find more information in hCaptcha's privacy policy.

Payment with PayPal

At checkout you can pay with PayPal. The provider is PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. If you choose PayPal, we transmit the data required for payment to PayPal, in particular name, address, email address, order number, invoice amount and currency. If you choose a PayPal payment method where you pay later, PayPal may carry out a credit check. PayPal processes your data under its own responsibility.

The legal basis is the performance of a contract (Art. 6 (1) (b) GDPR). You can find more information in PayPal's privacy policy.

Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children's data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Security and retention of your information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security". In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, to comply with legal obligations, to resolve disputes or to enforce other applicable contracts and policies.

Your rights and choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to access / know. You may have a right to request access to personal information that we hold about you.
  • Right to delete. You may have a right to request that we delete personal information we maintain about you.
  • Right to correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
  • Right of portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Managing communication preferences. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

If you reside in the United Kingdom or the European Economic Area, you may, subject to the exceptions and limitations of local law, exercise the following rights in addition to those listed above:

  • Right to object and right to restrict processing. You may have the right to ask us to stop or restrict our processing of personal information for certain purposes.
  • Withdrawal of consent. Where we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this does not affect the lawfulness of any processing based on your consent before its withdrawal.

You may exercise any of these rights where indicated on the Services or by contacting us using the contact details provided below. To learn more about how Shopify uses your personal information and any rights you may have, including rights related to data processed by Shopify, please visit https://privacy.shopify.com/en.

We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorised agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorised them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or to lodge your complaint with your local data protection authority. For the European Economic Area, a list of the competent data protection supervisory authorities is available here.

International transfers

Please note that we may transfer, store and process your personal information outside the country you live in.

Shopify is headquartered in Canada. For Canada, the European Commission has determined an adequate level of data protection (Art. 45 GDPR). The following service providers are based in the USA or may transfer data to the USA:

  • Cloudflare, Inc. (storage and processing for LoadIt Live),
  • Twitch Interactive, Inc. (Twitch player and Twitch chat for LoadIt Live),
  • Intuition Machines, Inc. (hCaptcha, protection of forms),
  • PayPal (transfer to PayPal, Inc. in the USA possible),
  • Shopify (transfer to subcontractors in the USA possible).

If a recipient in the USA is certified under the EU-US Data Privacy Framework, we base the transfer on the European Commission's adequacy decision of 10 July 2023 (Art. 45 GDPR). You can check whether a company is certified at https://www.dataprivacyframework.gov/list.

In all other cases where we transfer your personal information outside the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission's Standard Contractual Clauses (Art. 46 (2) (c) GDPR) or equivalent contracts issued by the relevant competent authority of the UK, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date and provide notice as required by applicable law.

LoadIt Live

LoadIt Live is a participatory campaign on delcube.com/pages/delcube-loadit and the pages of the individual editions. An image is created from the names entered. Once the target number is reached, the image can be ordered as a poster, also with one highlighted name. You can take part via the form on the page or with a command (for example !poster) in the Twitch chat of a participating stream.

What data we process

  • Via the form: the name you enter, the time and the source "website". We do not ask for an email address.
  • Via the Twitch chat: we read the public chat of the participating channel without logging in and in read-only mode. Each message is automatically checked for whether it contains the command. We do not store messages without the command; we only count them. If a message contains the command, we store your Twitch display name, your Twitch user ID and the time. We only use the ID so that every person counts once.
  • Moderation: we display the last 50 commands (display name, message, result) to ourselves in a password-protected moderation view. This list is only held in the server's memory and is not stored permanently.
  • When you order the name version, the chosen name appears in your order as the property "Name im Bild" (name in the image). The sections of this policy on orders apply to this.
  • In your browser: after you enter your name, your browser stores it in local storage (key dc-loaded-me:…) so that it can be highlighted for you. If you load the Twitch player with a click, your browser remembers this for the current session (dc-loaded-twitch). These entries remain on your device and are not transmitted to us. You can delete them in your browser settings.

We do not store IP addresses for LoadIt Live. Your requests are routed through Shopify (app proxy) to our server. Shopify passes on technical details such as shop, timestamp and signature and, according to Shopify, the customer ID for logged-in customers. We only check the signature and timestamp and do not store these details.

Purposes

  • showing your name in the image and on the poster,
  • preventing duplicate entries,
  • preventing misuse: a block list for inadmissible names, moderation and a rate limit that works without personal data,
  • producing the posters and fulfilling orders of the name version.

Who sees and receives your name

  • Publicly: your name appears visibly to everyone in the image on delcube.com and in the list of names available there.
  • In the stream: the image runs as an overlay in the participating creator's stream and is broadcast publicly by Twitch. Whether streams are recorded (videos, clips) is decided by the creator and Twitch.
  • On the posters: every printed poster of this campaign contains all names. Buyers therefore receive your name in print.
  • Service providers: Shopify (shop and forwarding of requests) and Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA (storage and processing on Cloudflare Workers).
  • Printing: Gelato AS, Snarøyveien 30 C, 1360 Fornebu, Norway, print on demand.
  • Twitch: if you take part via the chat, Twitch processes your message under its own terms.

Legal basis

Form: your consent via checkbox (Art. 6 (1) (a) GDPR). Twitch chat: your command in the chat after the notice in the overlay. Automatic checking of chat messages for the command: our legitimate interest in running the campaign (Art. 6 (1) (f) GDPR). Name version: performance of a contract (Art. 6 (1) (b) GDPR). Storage in the browser: Section 25 (2) No. 2 TDDDG.

Retention

We store your name until the end of the campaign, i.e. until 7 days after the poster is released. After that we delete the campaign's list of names. If you request deletion earlier, we remove your name earlier. We keep order data in accordance with statutory retention obligations.

Deletion and withdrawal

You can withdraw your consent at any time with effect for the future and request the deletion of your name. To do so, write to info@delcube.com and tell us your name in the image. We remove it from the image and delete it from our database. Posters that have already been printed and recordings of a stream can no longer be changed.

Embedded Twitch player

While a participating stream is live, we show the Twitch player (Twitch Interactive, Inc., 350 Bush Street, 2nd Floor, San Francisco, CA 94104, USA) on the LoadIt page. The player only loads once you have allowed marketing in our cookie banner or clicked "Load stream" below the player. Your browser then transmits data such as your IP address to Twitch, and Twitch may set cookies. The legal basis is your consent (Art. 6 (1) (a) GDPR, Section 25 (1) TDDDG). More information can be found in Twitch's privacy notice: https://www.twitch.tv/p/legal/privacy-notice/.
